M/I Homes proposed a 68-lot planned residential subdivision on approximately 29.8 acres of rolling agricultural land, with smaller lots exchanged for common open space, buffering, and coordinated design. Staff recommended approval with conditions, but the Zoning Commission recommended denial based on adjoining-property effects and conflicts involving zoning and planning policies, density, open space, sidewalk feasibility, and the preliminary-plan criteria. The Trustees rejected that recommendation and unanimously approved ZA2019-06 through Resolution No. 2-20 with 13 conditions.
ZA2021-01 revised the plan and conditions. After a 4-1 Zoning Commission recommendation, the Trustees approved Resolution No. 20-21, retaining masonry, house-size, basement, HOA, open-space, buffer, lighting, and agency-review requirements; requiring a community amenity; waiving the West Kemper sidewalk connection; and allowing later sale of the panhandle to adjoining owners as an administrative modification. The April 5, 2021 preliminary and final plans show 68 lots, 8.27 acres of open space, a playground, retention ponds, buffers, street trees, and entrance features.
MOD-21-1 revised the previously approved Abbeytown planned residential development while retaining 68 detached single-family lots on approximately 29.8 acres. The 2021 package refined the preliminary plan, open-space treatment, community amenity, house standards, buffers, HOA maintenance responsibilities, street lighting, sidewalk arrangement, and potential future disposition of the tract's narrow panhandle.
The Zoning Commission recommended ZA2021-01 approval by a 4-1 vote on March 2, 2021. The Trustees approved the revised plan through Resolution No. 20-21 with 11 conditions and separately granted a waiver for 1,010 feet of sidewalk along West Kemper Road through Resolution No. 21-21, requiring a $75,750 Sidewalk Fund deposit. The final development plan was approved May 18, 2021, subject to street-lighting, cluster-mailbox, Lot 17 sidewalk, and playground-installation conditions.
