Ewing Industries, Inc. sought to rezone approximately 40 acres at the southwest quadrant of Colerain and Springdale Roads to permit development of a planned shopping center. The proposal replaced an earlier shopping center and outdoor theater concept and ultimately became the basis for development of Northgate Mall.
The case generated substantial public participation, including petitions both supporting and opposing the proposal. The Regional Planning Commission and Rural Zoning Commission recommended approval, and the Hamilton County Board of County Commissioners approved the zoning change through Resolution No. 229. Ewing Industries, Inc. sought to revise the approved Northgate Mall development plan by removing an approximately 18,021-square-foot L-shaped parcel at the southwest corner of Colerain Avenue and Springdale Road. The parcel was adjacent to an existing Standard Oil Company service station and had been leased to Standard Oil, also identified in the file as Sohio. The proposal was intended to allow the service station property to be enlarged and redeveloped as a new Car Care Center.
Case 3-73 was closely related to Case 2-73, which involved the proposed rezoning of the same property from “EE” Planned Retail Business to “E” Retail Business. The development-plan revision required adjustments to parking and circulation in the northeast portion of Northgate Mall near the theater building. The Regional Planning Commission and Rural
Zoning Commission both recommended denial, primarily because they believed Ewing Industries should first bring the overall development into compliance with the previously approved plan. Despite those recommendations, the Board of County Commissioners ultimately approved the requested amendment through Resolution No. 474.

Ewing Industries, Inc. and the other Northgate Mall property owners sought revisions to the previously approved development plan for the approximately 73-acre shopping center.
The application followed concerns that portions of the completed development did not conform to the approved plan, particularly the required landscaped buffer and four-foot masonry wall. The final request focused primarily on relief from the Springdale Road masonry-wall requirement, relocation of the theater pylon sign, and pedestrian access from the residential area near Wilcox and Silva Drives.
Both the Regional Planning Commission and Rural Zoning Commission recommended denial. The Board of County Commissioners ultimately denied the requested modification of the masonry-wall requirement and denied the theater pylon-sign modification, but approved pedestrian entrances opposite Wilcox and Silva Drives, together with a hard-surface pathway and a barrier intended to prevent shopping carts from entering the adjoining residential area.
